DMCA / Intellectual Property Policy

Fan Gear Sport respects the intellectual property rights of others and expects our community to do the same. Our products are fan-inspired and are not officially licensed by, endorsed by, or affiliated with any team, league, athlete, or brand; all trademarks are the property of their respective owners. We are committed to responding promptly to clear notices of alleged copyright or other intellectual property infringement that comply with the U.S. Digital Millennium Copyright Act (DMCA) and applicable law.
If you believe that any content or product available on or through fangearsport.com infringes your intellectual property rights, please submit a written notice to our Designated Agent using the procedure below.
A. How to Submit a Notice of Infringement
It is Fan Gear Sport’s policy to (1) remove or disable access to any content or product listing (including, without limitation, text, graphics, images, and artwork) that we believe in good faith infringes the intellectual property rights of a third party after receiving a compliant notice; and (2) discontinue dealing with any supplier or partner who is a repeat infringer.
To be effective, your notice of infringement must be in writing and include the following:
- Identification of the copyrighted work, trademark, or other intellectual property that you claim has been infringed, including the registration number(s) where applicable;
- Identification of the material you claim is infringing, including (a) a description of how it uses the protected work in a way that constitutes infringement, and (b) the specific URL(s) or other location on the Fan Gear Sport website where the material appears, in enough detail for us to locate it;
- Your contact information, including your full name, mailing address, telephone number, and email address;
- A statement that you have a good-faith belief that the disputed use is not authorized by the intellectual property owner, its agent, or the law;
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the rights holder or are authorized to act on the rights holder’s behalf; and
- Your physical or electronic signature.

B. What Happens After We Receive a Valid Notice
Upon receiving a proper, good-faith notice of infringement, it is Fan Gear Sport’s policy to:
- Remove or disable access to the allegedly infringing content or product listing;
- Notify the affected supplier or partner, where applicable, that the material has been removed or disabled; and
- Terminate our relationship with, and remove content from, any supplier or partner that is found to be a repeat infringer.
C. How to Submit a Counter-Notice
If you believe that content removed or disabled by Fan Gear Sport was removed as a result of a mistake or misidentification, or that you have the right to use the content (including as a fair use or under a license), you may submit a written counter-notice to our Designated Agent containing the following:
- Identification of the content that was removed or disabled, and a description of where it appeared before it was removed or disabled;
- A statement, made under penalty of perjury, that you have a good-faith belief that the content was removed or disabled as a result of a mistake or misidentification;
- Your contact information, including your full name, mailing address, telephone number, and email address;
- A statement that you consent to the jurisdiction of the U.S. Federal District Court for the judicial district in which your address is located (or, if outside the United States, the judicial district in which Fan Gear Sport is located), and that you will accept service of process from the party who submitted the original notice; and
- Your physical or electronic signature.
If we receive a valid counter-notice, we may forward a copy to the original complaining party and inform them that we may restore the removed content in 10 business days. Unless the rights owner files a court action seeking to restrain the allegedly infringing activity, the removed content may be restored in 10 to 14 business days (or more) after receipt of the counter-notice, at Fan Gear Sport’s discretion.
Misrepresentations
Please be aware that under Section 512(f) of the DMCA, any person who knowingly and materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys’ fees.
